Terms of service
This website is operated by VaultedVIP.
Throughout these Terms of Service:
- “VaultedVIP,” “we,” “us,” and “our” refer to CAC Canada DBA Boujie Bags LLC, operating as VaultedVIP.
- “Customer,” “you,” and “your” refer to any visitor, purchaser, account holder, or person using the website.
By accessing the website, submitting information, creating an account, placing an order, or purchasing merchandise, you agree to:
- These Terms of Service
- The Refund Policy
- The Shipping Policy
- The Privacy Policy
- Product-specific disclosures
- Any additional terms presented before or during checkout
Do not use the website or place an order if you do not agree to these terms.
Scope of These Terms
These Terms govern direct retail purchases made through the VaultedVIP Shopify website.
Separate written terms may apply to:
- HiBid or Auction Flex auctions
- AuctionNinja auctions
- LiveAuctioneers auctions
- Third-party marketplaces
- Consignment transactions
- Wholesale transactions
- Special orders
- Payment arrangements
- Social-media sales
- Direct-invoice transactions
When a separate written agreement applies to a transaction, that agreement will control to the extent of a direct conflict.
Eligibility
Customers must be at least the age of majority in their jurisdiction and legally capable of entering a binding agreement.
The website may not be used for any unlawful, fraudulent, abusive, misleading, infringing, or unauthorized purpose.
Customer Information
Customers agree to provide complete, accurate, and current information, including:
- Legal name
- Billing address
- Shipping address
- Email address
- Telephone number
- Payment information
- Verification information requested for legitimate security purposes
Customers are responsible for promptly updating information associated with their account or order.
Account Security
Customers are responsible for maintaining the confidentiality of their account credentials and restricting unauthorized access to their devices and account.
Customers must promptly notify VaultedVIP of suspected unauthorized access or use.
VaultedVIP is not responsible for loss caused by a customer’s failure to reasonably protect their login credentials, device, email account, or payment information.
Orders Are Offers to Purchase
Submitting an order is an offer to purchase merchandise. It is not a guarantee that VaultedVIP has accepted or can fulfill the order.
An automated order confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance.
VaultedVIP may accept, reject, limit, review, hold, or cancel an order due to:
- Inventory unavailability
- Listing error
- Pricing error
- Payment failure
- Suspected fraud
- Identity mismatch
- Address mismatch
- Unauthorized payment activity
- Security concerns
- Technical errors
- Legal restrictions
- Inability to fulfill the order
If VaultedVIP cancels an order after collecting payment and does not provide the merchandise, the applicable payment will be refunded.
Payment Methods
VaultedVIP currently accepts or may offer payment services through one or more third-party payment processors, digital wallets, payment gateways, or financing providers, including:
- Afterpay
- Affirm
- Authorize.Net
- PayPal
- Shopify Payments
- Shop Pay
- Stripe
- Other payment or financing providers displayed at checkout
Available payment methods may vary based on the customer, product, transaction amount, location, risk review, device, or provider eligibility requirements.
Displaying a payment provider on the website does not guarantee that the provider will be available for every transaction or customer.
Payment Authorization
By submitting an order, the customer represents that:
- The customer is authorized to use the payment method.
- The payment information is accurate.
- The transaction is authorized.
- The purchase is not fraudulent.
- The customer understands that the transaction descriptor may display VaultedVIP, Bag Brats, CAC Canada DBA Boujie Bags LLC, Shopify, PayPal, Authorize.Net, or an associated payment processor.
The customer authorizes VaultedVIP and its payment providers to charge the full amount displayed at checkout, including merchandise, taxes, shipping, insurance, and other disclosed charges.
Payment Clearance
The one-to-three-week processing period begins after payment has been fully received and cleared.
A pending payment, temporary authorization, financing approval, or order confirmation does not necessarily establish that the funds have cleared.
Orders subject to payment-provider review, bank review, fraud review, identity verification, payment reversal, or authorization failure may remain on hold until payment is successfully verified.
Third-Party Payment and Financing Providers
When a customer selects a third-party payment or financing provider, that provider may independently collect and process personal and financial information.
Each provider operates according to its own:
- Terms of use
- Privacy policy
- Eligibility requirements
- Fraud-screening procedures
- Underwriting standards
- Security procedures
- Account restrictions
- Payment schedule
- Refund procedures
- Dispute procedures
VaultedVIP does not control a provider’s independent approval, denial, credit decision, financing decision, account limitation, payment schedule, interest, fee, collection activity, or processing time.
A third-party payment or financing arrangement does not modify the VaultedVIP Refund Policy, Shipping Policy, or Terms of Service.
Buy-Now-Pay-Later Services
VaultedVIP may offer installment-payment or financing services through providers such as Afterpay and Affirm.
Eligibility, approval, down-payment requirements, payment schedules, finance charges, interest, late fees, credit decisions, and account restrictions are determined by the applicable provider.
VaultedVIP does not:
- Make the provider’s financing or credit decisions
- Control provider eligibility requirements
- Determine provider interest or financing charges
- Collect installments owed directly to the provider
- Control the provider’s credit reporting or collection practices
- Guarantee approval
- Control how quickly the provider applies an approved refund
Prices and Listing Errors
VaultedVIP attempts to maintain accurate prices, descriptions, measurements, photographs, availability, and product information.
Errors may occur.
VaultedVIP may correct a typographical, photographic, technical, inventory, pricing, or descriptive error and may cancel an affected order before shipment.
VaultedVIP is not required to provide merchandise at an obviously incorrect price or under materially incorrect listing information.
Taxes
Customers are responsible for applicable:
- Sales taxes
- Use taxes
- Import taxes
- Value-added taxes
- Customs duties
- Tariffs
- Government charges
Taxes collected during checkout are determined using the address and transaction information available through Shopify and applicable tax services.
Final-Sale Agreement
All purchases are final.
The final-sale rule means that VaultedVIP does not accept customer-requested returns, refunds, exchanges, or cancellations except where required by law or expressly approved by VaultedVIP in writing.
The final-sale policy applies only to returns, refunds, exchanges, and customer-requested cancellations.
Shipping and fulfillment are governed separately by the Shipping Policy.
Before purchasing, the customer is responsible for reviewing:
- Item description
- Photographs
- Condition
- Measurements
- Materials
- Included accessories
- Disclosures
- Price
- Processing time
- Shipping terms
- Final-sale status
Merchandise and Condition
Customers understand that pre-owned and vintage merchandise may show signs of age, handling, storage, prior ownership, and use.
Condition descriptions are professional opinions rather than guarantees that every person will assign the same grade.
Minor natural, manufacturing, age-related, or screen-display variations do not automatically constitute a material misdescription.
Authenticity
VaultedVIP stands behind the authenticity representations expressly made in its listings.
Authentication is an expert-opinion process. Authentication companies, resellers, consignment businesses, marketplaces, and automated systems may use different methods or standards.
A third party’s refusal to purchase, consign, list, or accept merchandise does not by itself prove that the merchandise is counterfeit.
VaultedVIP may obtain an independent review before resolving an authenticity complaint.
Security Tags and Identifying Materials
VaultedVIP may attach or use:
- Security tags
- Tamper-evident devices
- Inventory labels
- Identifying marks
- Serial records
- Photographic records
- Packing video
- Other loss-prevention measures
Removing, altering, transferring, substituting, or damaging these materials may interfere with VaultedVIP’s ability to verify that returned or disputed merchandise is the same item originally shipped.
Prohibited Conduct
Customers may not:
- Use stolen or unauthorized payment information
- Misrepresent their identity
- Misrepresent their billing or shipping address
- Falsely deny authorizing a purchase
- Submit fabricated evidence
- Submit a knowingly false delivery claim
- Submit a knowingly false authenticity claim
- Submit a knowingly false damage claim
- Replace or switch merchandise
- Alter merchandise and claim it arrived altered
- Damage merchandise and claim it arrived damaged
- Remove security tags and attempt an unauthorized return
- Interfere with website security
- Upload malware or malicious code
- Scrape or copy website content without permission
- Gain unauthorized access to data or accounts
- Use the website in violation of law
Customer-Service Resolution Process
Customers are strongly encouraged to contact VaultedVIP before initiating a payment dispute so VaultedVIP has a reasonable opportunity to investigate and resolve the concern.
Order-related complaints should be sent to Support@VaultedVIP.com and include:
- Customer’s full name
- Order number
- Detailed explanation
- Requested resolution
- Photographs, video, reports, or other supporting evidence
VaultedVIP will ordinarily acknowledge a complete complaint within three business days.
VaultedVIP will attempt to provide a substantive response within ten business days. Carrier, insurance, authentication, payment-provider, or law-enforcement investigations may require additional time.
Nothing in this section prevents a customer from exercising a legitimate right to contact a bank, card issuer, payment provider, regulator, or law-enforcement agency.
Chargebacks and Payment Disputes
Customers agree to provide accurate and truthful information in any payment dispute.
A chargeback should not be used to avoid:
- A valid final-sale policy
- A disclosed processing period
- A validly authorized purchase
- A delivered order
- A lawful contractual obligation
- Good-faith communication concerning an order
VaultedVIP reserves the right to contest any unsupported, inaccurate, misleading, or fraudulent payment dispute using available evidence, including:
- Order confirmation
- Checkout acceptance records
- Policy acceptance records
- Applicable policy version
- Payment authorization
- Billing-address verification
- Shipping-address verification
- Fraud-screening results
- Device and account records
- Customer communications
- Product listing
- Product photographs
- Condition disclosures
- Authentication records
- Inventory records
- Packing photographs
- Packing video
- Shipment weight
- Carrier acceptance scans
- Tracking history
- Delivery confirmation
- Signature confirmation
- Carrier GPS records
- Delivery photographs
- Police reports
- Carrier findings
- Insurance findings
A customer must not knowingly claim that:
- An authorized purchase was unauthorized
- Delivered merchandise was not received
- An order was canceled when no cancellation was approved
- Merchandise was returned when it was not returned
- Authentic merchandise was counterfeit without credible supporting evidence
- The wrong item was received when the correct item was delivered
- Merchandise arrived damaged when the damage occurred afterward
Knowingly submitting false information or fabricated evidence may constitute a material breach of these Terms.
VaultedVIP may provide relevant records to payment providers, banks, carriers, insurers, marketplaces, authentication companies, regulators, or law enforcement as reasonably necessary.
Nothing in these Terms penalizes a customer for submitting a truthful, good-faith complaint or exercising a lawful consumer right.
Duplicate Recovery
A customer is not entitled to retain both the merchandise and a refund, chargeback credit, insurance payment, replacement, or other duplicate recovery for the same transaction.
If a customer receives both the merchandise and a refund or final charge reversal, the customer must reasonably cooperate in returning the merchandise or repaying the duplicated amount as legally appropriate.
A temporary or provisional chargeback credit does not establish that the customer is entitled to keep both the merchandise and the credit.
Costs Caused by Fraud or Material Breach
To the extent permitted by law, a customer may be responsible for actual losses and reasonable expenses directly caused by:
- Fraudulent conduct
- Merchandise substitution
- Intentional damage
- Knowingly false statements
- Fabricated evidence
- Unauthorized returns
- Material breach of these Terms
This provision does not apply merely because a customer submits a legitimate complaint or lawful payment dispute.
Third-Party Services and Links
The website may use or link to services operated by Shopify, carriers, payment processors, authentication providers, insurers, analytics providers, social-media companies, and other third parties.
VaultedVIP does not control every third-party service and is not responsible for the independent content, security, availability, terms, privacy practices, or actions of those third parties.
Intellectual Property
The website’s original:
- Text
- Product descriptions
- Photographs
- Videos
- Graphics
- Branding
- Logos
- Layouts
- Designs
- Marketing materials
- Other original content
are owned by or licensed to VaultedVIP and are protected by applicable intellectual-property laws.
Content may not be copied, reproduced, scraped, republished, modified, distributed, or commercially used without prior written permission except where legally permitted.
Third-party trademarks and brand names are used for identification and descriptive purposes. Unless expressly stated, VaultedVIP is not affiliated with, sponsored by, or endorsed by the applicable trademark owner.
Disclaimer of Warranties
To the fullest extent permitted by law, the website is provided on an “as available” basis, and applicable merchandise is sold in the condition described and photographed.
VaultedVIP disclaims implied warranties to the maximum extent permitted by law except for express written representations and warranties that cannot legally be excluded.
Nothing in this section eliminates a warranty or consumer right that cannot legally be waived.
Limitation of Liability
To the fullest extent permitted by law, VaultedVIP will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including:
- Lost profits
- Lost opportunity
- Loss of use
- Emotional distress
- Travel costs
- Missed events
- Replacement-rental costs
- Loss caused by an item not arriving by a customer’s preferred date
To the fullest extent permitted by law, VaultedVIP’s total liability arising from a website transaction will not exceed the amount the customer paid directly to VaultedVIP for the specific merchandise giving rise to the claim.
These limitations do not apply to fraud, willful misconduct, or other liability that cannot legally be limited.
Carrier and Third-Party Delays
VaultedVIP is not responsible for the independent acts or delays of carriers, customs authorities, payment processors, financing providers, insurers, authentication companies, internet providers, or other third parties.
VaultedVIP remains responsible for obligations that applicable law does not permit it to disclaim.
Force Majeure
VaultedVIP is not responsible for failure or delay caused by events outside its reasonable control, including:
- Severe weather
- Natural disaster
- Fire
- Flood
- Public emergency
- Epidemic
- War
- Terrorism
- Civil disturbance
- Government action
- Power failure
- Internet failure
- Cyberattack
- Carrier interruption
- Labor disruption
- Supply-chain interruption
- Building damage
- Theft
- Payment-network outage
- Other comparable events
This section does not eliminate any delay-notice, cancellation, or refund obligation imposed by applicable law.
Indemnification
To the fullest extent permitted by law, customers agree to indemnify and hold harmless VaultedVIP and its owner, affiliates, employees, contractors, and service providers from third-party claims and reasonable costs arising from the customer’s:
- Unlawful conduct
- Fraud
- Material breach of these Terms
- Misuse of the website
- Violation of another person’s rights
This provision does not require a customer to indemnify VaultedVIP for VaultedVIP’s own unlawful conduct.
Governing Law
These Terms and direct website transactions are governed by the laws of the State of Alabama and applicable federal law, without regard to conflict-of-law principles.
Venue
To the fullest extent permitted by law, any lawsuit arising from these Terms or a direct VaultedVIP website purchase must be filed in a court with proper jurisdiction in Jefferson County, Alabama.
This provision does not remove a customer’s non-waivable right to pursue a claim in another legally required venue.
Informal Resolution
Before filing a lawsuit, the parties agree to provide written notice of the dispute and requested resolution and allow at least thirty days for a good-faith attempt to resolve it.
This requirement does not apply when:
- Immediate legal relief is reasonably necessary
- A legal deadline would expire
- Applicable law prohibits the requirement
Severability
If any part of these Terms is found unlawful or unenforceable, it will be enforced to the maximum extent permitted or severed from the agreement.
The remaining provisions will remain in effect.
No Waiver
A failure by VaultedVIP to enforce a provision on one occasion does not waive the right to enforce it later.
Entire Agreement
These Terms, incorporated policies, product disclosures, checkout terms, and any applicable written transaction-specific agreement constitute the agreement between VaultedVIP and the customer concerning the website and direct website purchases.
Changes to These Terms
VaultedVIP may revise these Terms by posting an updated version with a revised “Last Updated” date.
The version presented and accepted at the time an order is submitted will ordinarily govern that order unless a change is required by law or separately agreed upon
